Mangomint Privacy Policy
Effective date: August 8, 2024Mangomint, Inc. (“Mangomint”, “we”, “us” and/or “our”) respects your privacy. This Privacy Policy describes how Mangomint collects and manages your personal information as part of providing our Services (as defined below).
- Scope and Applicability
This Privacy Policy describes our practices with respect to information that we collect, use, or disclose through:
- our website, https://www.mangomint.com/ (the “Website”); and
- our online business management software platform for salons, spas, and other businesses, and the applications through which we make the software available, including the web-based application available at https://app.mangomint.com/ and the Mangomint mobile app (the “App”) (collectively, the “Mangomint Software”).
This Privacy Policy refers to the Website and the Mangomint Software collectively as the “Services.”
This Privacy Policy primarily describes our handling of personal information that we collect and use through the Services for our own purposes, as a “controller.” That personal information includes: (i) the information we collect from and about visitors to our Website, and (ii) user and account information about individuals who use the Mangomint Software on behalf of the spas, salons, and other beauty and wellness businesses that subscribe to the Mangomint Software (our “Customers”), including their owners, staff, and independent contractors.
Our Customers also use the Mangomint Software to collect information from and about: (i) their current and prospective clients, including individuals who book appointments with, and purchase products and services from, those Customers through the Mangomint Software; and (ii) their employees and contractors, to manage their businesses using the Mangomint Software and Mangomint’s Payroll Processing services. When we handle this information, we do so as a “processor” or “service provider” to our Customers, and process that information at our Customers’ direction and in accordance with our agreements with them. The section below entitled “Our Processing of Information on Behalf of Mangomint Software Customers” generally describes our collection and handling of personal information on our Customers’ behalf as part of our provision of the Mangomint Software. We do not control, and are not responsible for, our Customers’ use and disclosure of that information. If you have questions about the use of your personal information by one of our Customers, please contact the Customer directly.
Except as otherwise expressly stated in this Privacy Policy, this Privacy Policy does not apply to information that we collect offline or through other channels that are not part of the Services.
- The Information We Collect and How We Collect It.
The information we collect, and how we use and disclose it, depends on the specific Services you use and on the context of your interactions with us. As explained below, we collect some of this personal information when you provide it directly to us. In other cases, we may receive personal information from third parties. We also collect certain information automatically when you use and interact with the Services.
- Information You Provide Directly
When you visit the Website or use the Mangomint Software as or on behalf of a Customer, we collect personal information that you choose to share with us when you use the Services, which may include information falling within the following categories:
- personal and contact details such as your name, mailing address, email address, and phone number;
- account and profile information such as your username, password, profile photo, and Mangomint ID;
- business information such as your company name and job title/position;
- payment and billing information;
- information that you choose to share when you fill out and submit contact forms or sign up for our newsletter through the Services; and
- information that you choose to share when you use online chat functionality that we make available through the Services, or otherwise communicate with us through the Services, which may be recorded by or through third-party service provider(s) who act on our behalf and at our express direction.
- Information We Receive from Third Parties
When you use the Mangomint Software, we may receive your personal information from third parties, including our Customers and their users, when they use the Mangomint Software, including your name and email address, to facilitate the creation of your account.
- Information We Collect Automatically
In addition to the information that you provide to us directly, or that we receive from third parties, when you use the Services, we collect some information automatically about you and your device. The types of information that we collect automatically may include:
- information about your computer or mobile device, such as IP and MAC address, operating system, browser type, and information about your mobile network and internet connection;
- usage and clickstream information, such as pages visited and features used; referring URLs; content you consume through the Services; mouse movements, clicks, and text entered; time spent using the Services and features thereof, and other details of your actions on the Services, which may be collected by or shared with our third-party service provider(s) to analyze and organize collected data on our behalf and at our express direction;
- transactional information, including information about purchases you make through the Services, such as product or service descriptions, price, subscription details, and times and dates of transactions;
- communications information, including the contents of communications you have through the Services, such as when you use the “Chats” feature on the Website or in the Mangomint Software;
- information collected in connection with third-party analytics technologies, such as Google Analytics (for more information on Google Analytics, including how Google Analytics collects, uses, and discloses information, please visit www.google.com/policies/privacy/partners/); and
- information about your location, including your approximate geographic location as indicated by your device’s IP address.
The technologies we use for this automatic data collection are described below.
- Cookies (or mobile cookies). We use cookies and similar technologies in connection with the Services to store and honor your preferences and settings, enable you to sign-in, provide interest-based advertising, combat fraud, analyze the performance of the Services, and to fulfill other legitimate business purposes. A cookie is a small file placed on the hard drive of your computer or your mobile device to store data that can be recalled by a web server in the domain that placed the cookie. This data often consists of a string of numbers and letters that uniquely identifies your computer, but it can contain other information as well. Some cookies on our Website are placed by third parties, such as companies we hire to provide analytics and advertising services on our behalf.
- Web Beacons. Pages of our Services and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that enable us and other companies we work with to provide analytics and advertising services to collect information about your use of the Services and interaction with our emails, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
- Software Development Kits (or “SDKs”). SDKs are pieces of code provided by our service providers, including development and analytics providers, that are incorporated into our App to collect and analyze certain device and user data.
- How We Use Your Information
We may use the personal information that we collect or receive through the Services for the following purposes:
- to provide, maintain, and support the Services;
- to perform our agreements with Customers;
- to respond to your inquiries and requests and communicate with you about the Services;
- to store information about your preferences and customize your experience on the Services;
- to analyze usage trends and patterns and measure the effectiveness of the Services;
- to advertise and market to you, including by sending you newsletters, special offers, and other information we think may be of interest to you, and engaging in interest-based advertising;
- to administer, evaluate, and improve our business and the Services (including developing new products and services; managing our communications; and performing accounting, auditing, billing, reconciliation and collection activities);
- to comply with legal or regulatory requirements, judicial process, and our company policies (including due diligence and contracting activities);
- to secure the Services, including by protecting against and responding to fraud, illegal activity (such as incidents of hacking or misuse of the Services), and claims and other liabilities, including by enforcing our customer agreements and Terms of Service;
- to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, including as part of bankruptcy, liquidation, or similar proceeding; and
- for any other purpose that you may authorize or direct at the time we collect your personal information.
- Our Disclosure of Your Information
We may disclose information we collect about you:
- to our contractors, service providers, payment processors, and other third parties we use to support our organization, which may include support of any of the data uses described above;
- to our Customers and their users to facilitate their use of the Mangomint Software, and as otherwise necessary to perform our agreements with them;
- to the providers of Third-Party Services we make available to Customers through the Mangomint Software, including payment processors and payroll processing providers;
- to third parties enabling or participating in targeted and cross-context behavioral advertising or that provide other online tracking technologies used in connection with the Services;
- to business partners involved in discount offers, product promotions, and co-branded offerings that we make available to you and that you choose to take advantage of when you use the Services;
- to our current and future parents, affiliates, subsidiaries and other companies under common ownership or control with us;
- to comply with applicable law, other legal requirements, and applicable industry and self-regulatory standards;
- to enforce our policies, terms of use, contracts, or other legal rights;
- to investigate or prevent unlawful activities or misuse of the Services;
- to protect against malicious, deceptive, fraudulent, or illegal activity, and participating in any prosecution or enforcement of laws or agreements meant to prevent or punish such activity;
- to operate, evaluate, debug, identify and repair errors, effectuate similar functional enhancements, and improve the Services and our other product and service offerings;
- to protect the legal rights, property, safety, and security of us, our users, our employees, and others;
- to an actual or potential buyer, successor, or other organization in the event of an actual or potential merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, including as part of bankruptcy, liquidation, or similar proceedings; and
- to such other parties as you may expressly authorize when we collect the information or otherwise ask for your consent or authorization.
- Our Processing of Information on Behalf of Mangomint Software Customers
Our Customers may use the Mangomint Software to collect and use information from and about: (i) clients who book salon and spa appointments with, and purchase products and services from, those Customers through the Mangomint Software; and (ii) their contractors and employees, in connection with the Customers’ management of their businesses and their use of Mangomint’s Payroll Processing services.
The personal information collected through the Mangomint Software by our Customers about their clients may include name and contact information such as phone number and email address, appointment information such as services booked and appointment times, records of products and services purchased, payment information such as payment card details, information about participation in loyalty or membership programs, the contents of messages transmitted between clients and the Customer through the Mangomint Services, notes that Customers maintain regarding clients and their preferences, and information contained in other files, including photos and documents, that Customers or their clients upload to the Services.
The personal information collected through the Mangomint Software by our Customers about their contractors and employees may include business information such as work experience and services offered; scheduling and timesheet information such as work schedules, working hours and breaks, and client appointments; and compensation and payroll information such as wages, commissions and other payments, Social Security Numbers or other national identification numbers, banking information, and tax documentation such as your W2 and 1095 tax forms.
When we receive this information about our Customers’ clients and employees in connection with our Customers’ use of the Mangomint Software, we do so as a “processor” or “service provider” to our Customers. To that end, we process the information for the purpose of providing the Mangomint Software and other services to those Customers, and our use and disclosure of the information is governed by our agreements with them. We may at those Customers’ direction provide that information to third party partners that provide certain services to those Customers as part of their use of the Mangomint Software, including third-party payroll and payment processing partners. For example, we and our Customers use Stripe for payments, analytics, and other business services. Stripe may collect personal information about our Customers’ clients as part of those services, including via cookies and similar technologies. The personal information Stripe collects may include transactional data and identifying information about devices that connect to its services. Stripe uses this information to operate and improve the services it provides to us and our Customers, including for fraud detection, loss prevention, authentication, and analytics related to the performance of its services. We are not responsible for and have no control over the privacy and data security practices of our Customers, which may differ from those explained in this Privacy Policy. If your personal information has been submitted to us in our role as a processor by or on behalf of a Customer and you wish to exercise any rights you may have under applicable data protection laws, please inquire with them directly. If you wish to make your request directly to us, please provide us the name of the Customer who submitted your data to us or on whose behalf we otherwise received it. We will refer your request to that customer, and will support them as needed in responding to your request within a reasonable timeframe.
- Your Choices
We provide you with choices with regard to your information. For example, you may choose not to provide the personal information we request through the Services. However, not providing information we request may restrict your ability to use certain features of the Services and our ability to provide our services to the Customer(s) with whom you are associated.
You may also be able to restrict the automatic collection of information when you use the Services by disabling cookies in your internet browser, but doing so may prevent you from using the functionality of the Services.
Some Internet browsers have a “do-not-track” feature that let you tell the Services that you do not want to have your online activities tracked. At this time, the Services do not respond to browser “do-not-track” signals, and other parties may collect personal information about your online activities over time and across different websites, applications, and other online products or services when you use the Services.
For information about interest-based advertising, and to opt out of this type of advertising by third parties that participate in self-regulatory programs, please visit the Network Advertising Initiative (NAI) opt out tool (http://www.networkadvertising.org/choices/) and/or the Digital Advertising Alliance (DAA) Self-Regulatory Program for Online Behavioral Advertising (https://youradchoices.com/). Please note that any opt-out choice you exercise through these programs will apply to interest-based advertising by the third parties you select, but will still allow the collection of data for other purposes, including research, analytics, and internal operations. You may continue to receive advertising, but that advertising may be less relevant to your interests.
- Children
Only persons age 18 or older have permission to access our Services. The Services are not intended for use by children under the age of 13, and we do not knowingly collect personal information from children under the age of 13.
- Third-party Links
The Services may include links to other websites, applications, information, and services provided by third parties. We are not responsible for the privacy policies or practices of those third parties. We encourage you to review the applicable privacy policies of such third parties if you elect to follow the links provided.
- Our Worldwide Practices
We operate internationally, and when you use the Services your personal information may be received in or transferred to locations outside the jurisdiction in which you are located. The data protection laws in these locations may differ from the jurisdiction where you are located and may not provide the same level of protection compared to the laws in the jurisdiction in which you are located.
- Changes to this Policy
We may update this Privacy Policy to reflect changes in our privacy practices at any time. When we do so, we will update the Effective Date of the Privacy Policy above. We encourage you to periodically review this Privacy Policy for the latest information on our privacy practices.
